Tariff Increase Implementation As Negotiations Continue


The Office of the United States Trade Representative has published in the Federal Register notice of the proposed increase of Duty from 10% to 25% effective tomorrow, May 10, 2019.

As a reminder, the list of goods affected was originally scheduled to increase to 25% in September 2018 before being implemented at a reduced 10%, with a subsequent increase to 25% planned to go into effect on January 1st. This January increase was delayed to March 1st, and" Then again postponed without a specific implementation date set until President Trump’s recent comments informing that the increase would go into effect tomorrow Friday, May 10th.

Notably, there is specific language in the Federal Register Notice excluding shipments from the increase that have been exported May 9, 2019 or earlier.

Effective with respect to goods (i) entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on May 10, 2019 and before June 1, 2019, and (ii) exported to the United States on or after May 10, 2019.”
